Indemnity Waiver Agreement for Research Peptides

This Indemnity Waiver Agreement (“Agreement”) is a legally binding contract between Trivial Bioworks (“Company,” “we,” “us,” or “our”) and any individual or entity accessing this website, creating an account, or purchasing products from Trivial Bioworks (“Customer,” “you,” or “your”).

1. Research Use Only Acknowledgment

By accessing this website or purchasing research compounds, peptides, or amino products from Trivial Bioworks, you acknowledge and agree that:

1. All products sold by Trivial Bioworks are intended strictly for laboratory research purposes only, including in vitro research applications.
2. Products are not approved for human consumption, animal consumption, veterinary use, diagnostic use, therapeutic use, or any form of bodily introduction, as prohibited by law.
3. Products have not been evaluated, tested, or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.
4. You assume sole responsibility for the lawful handling, storage, documentation, use, and disposal of all products in accordance with:
   • Applicable local, state, and federal laws and regulations
   • Industry safety standards and best practices
   • Proper laboratory research protocols
5. Any failure to comply with these requirements fully releases Trivial Bioworks from all obligations, responsibilities, and liabilities under this Agreement.

2. Age Verification & Legal Eligibility

You represent, warrant, and agree that:

1. You are at least twenty-one (21) years of age.
2. You are legally authorized to purchase and possess research-use-only compounds in your jurisdiction.
3. Trivial Bioworks does not sell products to individuals under the age of 21.
4. Trivial Bioworks may require valid government-issued identification or other verification methods to confirm eligibility.
5. You are solely responsible for ensuring compliance with all applicable local, state, and federal laws governing the purchase, possession, handling, and use of the products.

3. No Medical Claims; No Warranties

You acknowledge and agree that:

1. Trivial Bioworks makes no express or implied medical, therapeutic, diagnostic, or health-related claims regarding its products.
2. No guarantees or representations are made regarding:
   • Research outcomes
   • Product performance
   • Efficacy or results
3. All products are provided “as is” and “as available,” without warranties of any kind, including but not limited to:
   • Implied warranties of merchantability
   • Fitness for a particular purpose
   • Non-infringement

4. Assumption of Risk & Release of Liability

You knowingly, voluntarily, and expressly assume all risks associated with the purchase, possession, handling, use, misuse, or disposal of Trivial Bioworks products and agree that:

1. Trivial Bioworks shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:
   • Personal injury or death
   • Property damage
   • Loss of profits or data
   • Regulatory actions or penalties
2. This limitation of liability applies even if Trivial Bioworks has been advised of the possibility of such damages.
3. You hereby waive, release, and discharge Trivial Bioworks and its owners, officers, employees, agents, contractors, and affiliates from any and all claims arising from or related to the products.

5. Indemnification

You agree to indemnify, defend, and hold harmless Trivial Bioworks and its owners, officers, employees, agents, and affiliates from and against any and all:

• Claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees)
• Fines, penalties, or regulatory enforcement actions
• Third-party claims for injury, death, or property damage

arising out of or related to your purchase, possession, handling, use, misuse, or disposal of the products, or your violation of this Agreement or applicable law.

6. Gated Access & Customer Verification

You acknowledge and agree that:

1. Access to the website, product listings, and checkout is restricted through age verification and research-use-only acknowledgment.
2. Checkout and account access require Know Your Customer (KYC) verification, which may include name, email address, and one-time password (OTP) authentication.
3. All personal information is collected and processed in accordance with applicable data protection and privacy laws.
4. Trivial Bioworks reserves the right to suspend, restrict, or terminate access or accounts if false information is provided or if misuse or non-compliance is suspected.

7. Binding Agreement & Governing Law

1. This Agreement is binding upon you and your heirs, executors, administrators, successors, and assigns.
2. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
3. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
4. Any dispute arising out of or relating to this Agreement shall be resolved exclusively in the state or federal courts located in Riverside County, California.

8. Acceptance by Age Verification, Website Use, and Purchase

By accessing this website, completing age verification, selecting “Yes, I am 21 or older,” creating an account, or purchasing any products from Trivial Bioworks, you acknowledge that:

1. You are at least twenty-one (21) years of age.
2. You have read, understood, and agree to be legally bound by this Indemnity Waiver Agreement, the Terms and Conditions, and all related policies.
3. Your continued access to the website and any purchase constitutes affirmative acceptance of this Agreement.
4. Your electronic acceptance is intentional, voluntary, and legally equivalent to a handwritten signature under applicable electronic signature and transaction laws.
5. A printed or electronic copy of this Agreement shall be admissible in any legal or administrative proceeding.
